These Terms and Conditions apply to the purchase of goods from the online store vintagevaibad.ee (hereinafter referred to as the “Online Store”).

The owner and seller of the Online Store is:

Aprvh OÜ
Registry code: 16600920
Vooru tee 13, Kaagvere küla, Kastre vald, 62317 Tartumaa, Estonia
E-mail: info@vintagevaibad.ee

These Terms and Conditions govern the rights and obligations arising from purchases made through the Online Store between Aprvh OÜ (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Buyer”).

In addition to these Terms and Conditions, purchases made through the Online Store are governed by the laws and regulations applicable in the Republic of Estonia.

1. Products and Prices

The prices of products sold in the Online Store are displayed in euros next to the respective products.

Aprvh OÜ is not registered for VAT, and VAT is therefore not added to the prices.

The delivery fee is added to the product price and depends on the selected delivery method. The delivery fee is displayed to the Buyer in the shopping cart or during checkout before the order is confirmed.

Product photographs displayed in the Online Store are as accurate as possible; however, colours may differ slightly from the actual product depending on the screen and device settings.

2. Special Characteristics of Vintage Carpets

The carpets available from Vintage Vaibad are generally previously used, older handmade carpets, and each carpet is a unique piece.

Due to their age and previous use, carpets may have natural signs of wear, colour variations, irregularities, repairs or other characteristics typical of their age.

The known condition and significant characteristics of each carpet are described in the product description and shown in the photographs.

Characteristics and signs of wear that are clearly stated in the product description or shown in the photographs and of which the Buyer was informed before purchase shall not, solely due to their presence, be considered non-conformity of the goods with the terms of the contract.

As handmade carpets, minor variations in dimensions may occur, and measurements are provided as accurately as possible.

If the exact age of a carpet is unknown, an estimated age may be stated in the product description.

If the Buyer has any questions before purchase regarding the condition, colours, dimensions or other characteristics of a particular carpet, we recommend contacting the Seller before placing the order.

3. Placing an Order

To place an order, the Buyer must:

1. select the desired product and add it to the shopping cart;
2. proceed from the shopping cart to the checkout page;
3. enter the information required to process the order;
4. select a suitable delivery method;
5. select a suitable payment method;
6. review and accept these Terms and Conditions;
7. confirm the order and pay for the purchase.

Before confirming the order, the Buyer has the opportunity to review the entered information and the order and make any necessary changes.

After placing the order, an order confirmation will be sent to the Buyer’s e-mail address.

The sales contract enters into force once the order has been confirmed and the amount due for the order has been received.

As each carpet is generally a unique piece, a carpet that has been sold will be marked as sold after the purchase and cannot be purchased again. A sold carpet may remain visible in the Online Store’s archive of sold carpets.

If the ordered goods cannot be delivered, for example due to a technical error or a simultaneous sale, the Seller will contact the Buyer as soon as possible and refund the amount paid.

4. Payment

Orders placed in the Online Store can be paid using the payment methods displayed during checkout.

Payments are processed by Maksekeskus AS.

Payment takes place outside the Online Store in a secure payment environment – for bank payments in the respective bank’s environment and for card payments in the Maksekeskus AS payment environment.

The Seller does not have access to the Buyer’s internet banking authentication details or complete bank card details.

5. Delivery

The Buyer can choose from the delivery methods offered during checkout.

  • SmartPost parcel locker

Where possible, the order can be delivered to the Itella parcel locker selected by the Buyer.

The parcel locker delivery option is displayed only for orders whose dimensions and other characteristics allow delivery via a parcel locker.

  • SmartPost courier

For larger carpets or at the Buyer’s request, Itella courier service may be selected.

Orders delivered by courier will be sent to the address provided by the Buyer during checkout.

The delivery price is displayed during checkout before the purchase is confirmed.

Orders are generally handed over to the transport service provider within 1–3 business days after payment has been received.

The estimated delivery time is 5–10 days.

If delivery of the order is delayed, the Seller will inform the Buyer as soon as possible.

The Buyer is responsible for the accuracy of the contact and delivery information provided in the order.

6. Receiving the Order

Upon receiving the goods, we recommend that the Buyer check the condition of the goods and packaging as soon as possible.

If the shipment has been visibly damaged during transport, please, where possible, notify the transport service provider immediately and also contact the Seller at: info@vintagevaibad.ee

Where possible, please take photographs of the damaged packaging and product.

7. 14-Day Right of Withdrawal and Return of Goods

A Buyer who is a consumer has the right to withdraw from a sales contract concluded through the Online Store without giving a reason within 14 days from the day on which the Buyer, or a third party designated by the Buyer other than the carrier, received the goods.

To exercise the right of withdrawal, the Buyer may submit a withdrawal statement using the online form available on the Online Store’s "Return Goods" page. The withdrawal statement may also be submitted by e-mail to info@vintagevaibad.ee.

The Seller will immediately confirm receipt of a withdrawal statement submitted through the online form by e-mail. The confirmation will contain the content of the withdrawal statement and the date and time it was submitted.

To submit a withdrawal statement, it is sufficient for the Buyer to provide at least their name, the information necessary to identify the order, and an e-mail address to which confirmation of receipt of the withdrawal statement can be sent.

After submitting the withdrawal statement, the goods must be returned or handed over to the Seller no later than within 14 days.

Return address:
Vooru tee 13, Kaagvere küla, Kastre vald, 62317 Tartumaa, Estonia

Condition of Returned Goods

The Buyer has the right to examine the goods and assess their suitability in the same manner as would be possible in a regular physical store.

The returned carpet must be handled with due care while in the Buyer’s possession. Carefully unpacking and unrolling the carpet and assessing its dimensions, colour and suitability in a room does not, in itself, exclude the exercise of the right of withdrawal.

If the Buyer has used the goods more than is necessary to establish their nature, characteristics and suitability, and this has resulted in a reduction in the value of the goods, the Seller has the right to claim compensation for the reduction in value to the extent permitted by law.

A reduction in the value of a carpet may occur, for example, if while in the Buyer’s possession the carpet has:

  • become dirty or stained;
  • been damaged;
  • undergone unusual wear;
  • acquired a strong odour;
  • been cleaned or treated in a manner that has altered its condition.

The natural characteristics of vintage carpets resulting from their age and previous use, as well as signs of wear clearly stated in the product description or shown in photographs before purchase, do not constitute a reduction in value caused by the Buyer.

Return Costs

The direct costs of returning the goods to the Seller are borne by the Buyer, unless otherwise agreed between the Seller and the Buyer.

As carpets may vary in size and weight, the cost of returning a carpet depends on the dimensions and weight of the particular shipment and the selected transport service.

Before returning a larger carpet, we recommend contacting the Seller at info@vintagevaibad.ee to agree on a suitable return method.

Refunds

Upon withdrawal from the contract, the Seller shall refund the Buyer all payments received for the returned goods, including the initial delivery cost paid by the Buyer.

If the Buyer selected a delivery method that was more expensive than the cheapest standard delivery method offered by the Seller, the Seller is not required to reimburse the portion exceeding the cost of the cheapest standard delivery method.

The Seller shall issue the refund without undue delay and no later than 14 days from receipt of the withdrawal statement.

The Seller has the right to postpone the refund until the returned goods have been received by the Seller or the Buyer has provided proof that the goods have been sent back, whichever occurs first.

The refund will be made using the same payment method used by the Buyer for the original purchase, unless otherwise agreed between the Buyer and the Seller and provided that this does not result in any additional costs for the Buyer.

8. Goods Not in Conformity with the Contract and Complaints

The Seller is liable for non-conformity of goods sold to the Buyer to the extent provided by law.

A Buyer who is a consumer has the right to submit a complaint regarding non-conformity of the goods with the terms of the contract within two years from receipt of the goods.

If a defect is discovered, please notify the Seller as soon as possible, but no later than within two months of discovering the defect.

Complaints can be submitted by e-mail to: info@vintagevaibad.ee

Please include the following in the complaint:

  • Buyer’s name and contact details;
  • order number or other proof of purchase;
  • description of the problem;
  • photographs of the defect, where possible;
  • the solution requested by the Buyer.

The Seller will respond to a written complaint no later than within 15 days.

If the goods have a defect for which the Seller is responsible, the matter will be resolved in accordance with applicable law, taking into account, among other things, the possibilities of repair, replacement, price reduction or withdrawal from the sales contract.

As Vintage Vaibad generally sells unique carpets, it may not be possible to replace a carpet with an identical product. In such cases, an appropriate solution in accordance with the law will be agreed with the Buyer.

The right to submit a complaint does not cover defects or characteristics of which the Buyer was informed before purchase and which were clearly stated in the product description or shown in the photographs.

The Seller is also not responsible for damage that occurs after the goods have been handed over if such damage was caused, for example, by improper use, maintenance, cleaning or external influences.

9. Carpet Care

For regular carpet care, we recommend careful vacuuming.

It is recommended to rotate the carpet from time to time so that wear and the effects of sunlight are distributed as evenly as possible.

In the event of heavy stains or the need for more thorough cleaning, we recommend using professional cleaning services suitable for handmade carpets.

Before using strong cleaning products, we recommend consulting the Seller, as an unsuitable cleaning method may damage the carpet’s material or colours.

10. Processing of Personal Data

The Seller processes the Buyer’s personal data for the purpose of fulfilling orders, processing payments, delivering goods and fulfilling other obligations related to the Online Store.

More detailed information about the processing of personal data is provided in the Online Store’s Privacy Policy.

11. Dispute Resolution

If the Buyer has a complaint regarding the Online Store, we ask that they first contact the Seller by e-mail at: info@vintagevaibad.ee

The Seller and the Buyer shall endeavour to resolve any disputes through negotiation.

If the consumer Buyer and the Seller are unable to resolve the dispute by agreement, the Buyer has the right to contact the Consumer Disputes Committee operating under the Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet) or to turn to a court.

12. Amendments to the Terms and Conditions

The Seller has the right to amend these Terms and Conditions.

The Terms and Conditions applicable to a purchase are those that were in force at the time the order was placed.

The current version of the Terms and Conditions is published on vintagevaibad.ee.
